SMS Mobile Messaging

Montage Health uses short message service (“SMS”) mobile messaging (i.e., text messages) to notify patients about its services. Please read the following Terms and Conditions before using our SMS mobile messaging service.

Text messages should not be relied on or used for emergency communications. In most cases, text messages are one-way communications to which recipients cannot reply.

Terms and Conditions

1. When you sign-up for Montage Health’s SMS mobile messaging services, you authorize and agree to receive text messages related to your relationship with Montage Health, including updates related to your visits, MyChart account, one-time passcode, billing notifications, and care management. Agreement to receive text messages is not required for patients to receive treatment from Montage Health.

By agreeing to receive text messages, you agree that the mobile number is yours and that you have permission to use that mobile number. You must let us know right away if you change your mobile number or you no longer have permission to use the mobile number for texting.

2. You can stop receiving text messages from us at any time by texting STOP to the short code sending the message. After replying STOP, you will receive one final message confirming that you have unsubscribed. You will no longer receive text messages from the short code. If you want to join again, sign-up using MyChart or text HELP to the short code for instructions.

3. If you experience issues with our SMS mobile messaging service, text HELP for more assistance, or contact 831-625-4559 or email SMSService@montagehealth.org.

4. Mobile carriers are not liable for delayed or undelivered messages.

5. Message and data rates from your mobile carrier may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have questions about your text or data plan, contact your mobile carrier.

7. Information gathered through your use of our SMS mobile messaging service will not be shared for marketing purposes.

8. SMS communications are not secure or encrypted and third parties can sometime intercept messages or disguise messages as though we sent them. You agree that you will not text Montage Health any confidential or sensitive information.

9. If you do not agree to the Terms and Conditions, you must not access or use our SMS mobile messaging service.

SMS Mobile Messaging Privacy Policy

Montage Health offers SMS mobile messaging (hereafter “the Service”) to notify patients about its services. We respect your privacy and are committed to protecting it through our compliance with this SMS Mobile Messaging Privacy Policy ("Privacy Policy"). Please see our Notice of Privacy Practices, which explains how we process your information and how your information may be used at Montage Health.

This Privacy Policy is entered into by and between you and Montage Health. This Privacy Policy describes the information we collect from you or that you may provide when you use the Service, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Acceptance of the Privacy Policy and Terms of Use

This Privacy Policy is effective with respect to any data that we have collected, or collect, about and/or from you, according to our SMS Mobile Messaging Terms and Conditions (“Terms and Conditions”), which is incorporated herein by reference. Please read this Privacy Policy carefully before you use the Service. By using the Service, you accept and agree to be bound and abide by this Privacy Policy. If you do not agree to the Terms and Conditions or this Privacy Policy, you must not access or use the Service.

No Collection of Personal Information

We do not knowingly collect any personally identifiable information about you through your use of the Service. Information gathered through your use of the Service will not be shared for marketing purposes.

Security

If a security breach causes an unauthorized intrusion into our system that materially affects you, then we will promptly notify you in accordance with applicable legal requirements.

No Liability

You understand that electronic communications may be accessed by unauthorized parties when communicated across the Internet, network communications facilities, or other electronic means. You agree that we are not responsible for any electronic communication and/or any of your data which may be lost, altered, intercepted, or stored without authorization during the transmission of any data whatsoever across networks not owned and/or operated by us. We do not guarantee that your information will not be misused or disclosed to third parties. We will not have any liability to you for any such misuse or disclosure.

Except as required or allowed by law, we will not use or disclose your information for any purpose for which you refuse us consent or later withdraw your consent. If you withdraw consent, you agree that despite this withdrawal we may continue to use the information previously provided to us to the extent that we are legally or contractually obligated to do so and to the extent necessary to enforce any contractual obligations you may have to us.

Indemnity

To the maximum extent permitted by applicable law, and in consideration for our permitting you to use the Service, you hereby expressly release and hold harmless Montage Health, and its officers, directors, employees, agents, and assigns from any and all claims, liabilities, demands, causes of action, costs, expenses, and damages of every kind and nature, in law or equity, or otherwise, arising out of or in any way related to your use of the Service, whether arising from negligence or any other acts or omissions by Montage Health. In addition, you will indemnify and hold harmless Montage Health, and its officers, directors, agents, affiliates, and employees, against all actual and direct losses, liabilities, damages, claims, costs or expenses (including reasonable attorney’s fees) it may suffer as the result of third party claims, demands, actions, investigations, settlements, or judgments against it arising from or in connection with any breach of the Terms and Conditions, or from any breaches of confidentiality or negligence or wrongful acts or omissions, by you or your dependents, or agents. The provisions of this section entitled “Indemnity” shall survive termination of your agreement to the Terms and Conditions.

Applicable Law, Venue

The Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflicts of law principles. You agree that venue for any dispute, controversy, or claim arising out of or related to the Terms and Conditions, or your use of the Service, will be Monterey, California.

Changes to this Privacy Policy

We reserve the right to make changes to this Privacy Policy and to our information gathering and dissemination practices. If we decide to change this Privacy Policy, which we may do at any time without notice to you, we will post those changes. We suggest that you periodically check our Montage Health website for changes to this Privacy Policy.
